Withdrawal from the Agreement and Refunds

  1. A Consumer who has concluded an Agreement may withdraw from it without giving any reason by submitting an appropriate statement in writing within 14 days from the date of concluding the Agreement. To meet the deadline, it is sufficient to send the statement before its expiry. In the event of withdrawal from the Agreement, the provisions of Art. 27 et seq. of the Consumer Rights Act shall apply to matters not regulated in these Terms and Conditions.
  2. With the express consent of the Consumer granted prior to placing the Order (including prior to making the Payment), the performance of the Service by the Service Provider shall commence upon confirmation of the payment for the Service by the Service Provider in accordance with the Terms and Conditions, and thus before the expiry of the period referred to in paragraph 7 provided for withdrawal from the Agreement. Pursuant to Art. 38 point 13 of the Consumer Rights Act, if the consent referred to in the preceding sentence is granted, the Consumer loses the right to withdraw from the Agreement if the Service Provider performs the service before the expiry of the period referred to in paragraph 7.
  3. To exercise the right to withdraw from the Agreement, it is necessary to:
    • In the case of a Free Service: close the Service Website;
    • In the case of a Paid Service: send explicit information regarding withdrawal to the e-mail address: kontakt@makeupfitness.com using, for example, the template provided below:
I hereby declare that I withdraw from the Agreement regarding the following Digital Services:
Product/Service Name: ___________
Gross Price: ___________
First and Last Name: ___________
Date of Conclusion of Agreement: ___________
Signature and Date: ___________
Refunds shall be made using the same payment method as chosen by you.
  1. The User may place Orders 24 hours a day.
  2. If the User wishes to receive an invoice, they should inform the Service Provider before making the payment on the Service Provider's website or via an e-mail message to the address: kontakt@makeupfitness.com, providing the details necessary for issuing an invoice, or complete the relevant form during the order process, if the Service Provider makes such a form available.
IIIa. PROVISIONS CONCERNING SOLE PROPRIETORS WITH CONSUMER RIGHTS
  1. A natural person conducting a sole proprietorship is covered by the protection provided under the Consumer Rights Act, provided that the Agreement concluded with the Service Provider is not of a professional nature for that business.
  2. The person conducting business activity referred to in paragraph 1 of this section is covered by protection exclusively in respect of:
    • a) prohibited contract terms — so-called unfair terms,
    • b) statutory warranty liability for physical and legal defects,
    • c) the right to withdraw from a distance contract, in accordance with Section III paragraph 7 of the Terms and Conditions.
  3. The entrepreneur referred to in paragraph 1 of this section loses consumer protection rights if the Agreement concluded with the Service Provider is of a professional nature, which is verified on the basis of the entry of this entrepreneur in the Central Register and Information on Economic Activity of the Republic of Poland (CEIDG), in particular the Polish Classification of Activities (PKD) codes listed therein.
  4. The entrepreneurs referred to in point 1 of this section are not covered by institutional protection provided to Consumers by county (municipal) consumer ombudsmen or by the President of the Office of Competition and Consumer Protection (UOKiK).
